Tropique Draws Its Sword and Slays The Giant!
It's the classic story of David vs. Goliath: The smaller, seemingly powerless beings step up to face the mighty giant - slingshot and all. The case of Musique Tropique vs. Interscope Records, A&M Records, Universal Music and Video Distribution, Organized Noize Productions and Frederick Bell reminds me of such a great myth. And, in fairy tale fashion, the tiny opponent triumphs over the monsterous aggressor.
On April 7th, a nine-member jury found Interscope, A&M, Universal, and Organized Noize guilty of copyright infringement.
Organized Noize rap artist Frederick Bell was discovered to have illegally used the name "Cool Breeze" on his albums - a trademark legally owned by the Musique Tropique label. Numerous videos utilizing the "Cool Breeze" trademark also accompanied the music that was distributed by Universal Music and Video Distribution.
As a result, Bell's records and videos were taken off the shelves and he was ultimately let go by Interscope. Musique Tropique's "Cool Breeze" is set for an album release in June titled "New Orleans tropical."
"They battled tremendous odds, against the largest record company in the world," said Musique Tropique CEO Pietro Giacomo Poggi enthusiastically. "I am delighted and gratified by the verdict. It was a major victory for the little guys..."
This little guy may be victorious in more ways than one. Ask yourself this: Does releasing Bell mean that the wound Interscope sustained from the ordeal is immediately patched up? Was Interscope completely oblivious to Bell's misuse of the trademark? It seems that a hot-shot label such as Interscope would rather let the artist take a hit before their oh-so-sensitive corporate structure is put under fire. This doesn't exactly excuse Bell, but occasionally the industry's harsh underbelly is exposed.
