InterTrust sues Microsoft. Again.

InterTrust Technologies Corp already has lawsuits against Microsoft for alleged patent infringement by such MS products as its Media Player, eBook reader, Digital Asset Server, and the Windows XP product activation process, all of which employ DRM functionality. Last September, it added three new patents and the claim that Microsoft's .NET initiative infringes, "numerous InterTrust patents," says the company. A hearing to interpret some of the claims is slated for early September.

Now InterTrust has filed a new, and separate, lawsuit, this time claiming infringement by MS' Plug and Play Driver Certification Program of InterTrust's US patent 6,157,721 (721). It calls for unspecified damages and an injunction prohibiting, "unlawful use" of InterTrust's patented technology which it says discloses, for example, new technologies and methods for specifying, certifying, and verifying attributes of software executables that allow third parties to, "attest to the trustworthiness of software executables and permits computing devices to maintain a trusted digital environment".

InterTrust says Microsoft's Plug and Play Driver Certification program is positioned as being central to delivering Windows XP's promises of an improved user experience, greater operating system reliability and fewer system crashes and, says InterTrust, it believes Microsoft's Driver Certification is important to " 'Trustworthy Computing', which Bill Gates recently declared the company's highest priority. In a recent open email to Microsoft staff, says InterTrust, Gates said trustworthy computing is, "computing that is as available, reliable and secure as electricity, water services and telephony. Today, in the developed world, we do not worry about electricity and water services being available... Computing falls well short of this, ranging from the individual user who isn't willing to add a new application because it might destabilize their system, to a corporation that moves slowly to embrace e-business because today's platforms don't make the grade'."
