Radio station fined for "indecent language"

Chicago's WKQX(FM) has been fined $21,000 by the FCC for, "willfully and repeatedly broadcasting indecent language on three occasions". Licensed by the Emmis Radio License Corp, the station broadcast indecent material on March 6, 2001, March 7, 2001 and May 17, 2001 during the "Mancow's Morning Madhouse" program, according to a complaint made to the Commission.

In a long report, the FCC said Emmis claimed it didn't have tapes or transcripts of the programming aired on the dates cited, and that Emmis had contended, "even assuming the accuracy of the transcripts, the programming at issue is not actionably indecent. Specifically, Emmis contends that the material broadcast is not patently offensive as measured by contemporary community standards for the broadcast medium."

Addressing whether the material was explicit or graphic, the FCC said the March 7 broadcast concerned, "the use of a sexual stimulant by a female cast member as well as her appearance in a video, and includes explicit and graphic references to sexual organs and activities. This material is similar to other material with graphic and explicit sexual references that has been found indecent.

"The material broadcast on March 6, 2001 is a discussion of sexual and excretory responses to viewing pornography and contains sexual references that rely on innuendo. Likewise, the sexual references in the material broadcast on May 17, 2001 - a discussion by a female cast member and a number of women guests in the 'lava lamp love lounge'- relies in part on innuendo."
