Boo-Jetto accuses Universal Records of trademark infringement

Bourghetto.com (pronounced Boo-Jetto, says the company) is a "one stop shop for all your editorial and design needs."

To make a point, Bourghetto owner D.C. Livers states on his web page: "All marks using any version - including words intentionally misspelled are a violation of the trademark. A formal application has been officially registered with the United States Patent & Trademark Office in Virginia. In addition, the copyright for Boughetto/Bourghetto has been applied for with the United States Library of Congress Copyright Office. Boughetto and Boughetto.com are violating this trademark and infringing on the copyright."

Apparently, Universal rap artist Ali recently released his first single called, you guessed it, 'Boughetto' which Livers says, "breaks down the lifestyle of the bourgeois and the ghetto." However, he says, he'd already registered the domain name nearly a year before, "rap artist Ali began using the word."

He goes on, "There is currently a trademark violation and domain dispute filed with ICANN (Internet Corporation for Assigned Names and Numbers) against Universal Records recording artist, Ali and Brandon Hauber who has unethically registered the domain name Boughetto.com. US anti-cybersquatting laws prohibit typosquatters (misspelling domains to confuse web visitors) and cybersquatting. Hauber has refused to transfer the domain name back to DC Livers and so the trademark dispute begin on March 12, 2002."

In a press release, Livers says, "Radio One [RO] owns the 95.5 FM station where Ali hosts his radio show. RO's Linda Vilardo has been contacted about the situation. It is our hope that Radio One, Ali and Universal Records will do the right thing, but Bourghetto.com has no choice but to impose a deadline April 30, 2002," adding:

"Vivendi Universal has been a proven leader and showed its commitment to stopping the copyright and trademark infringement of creative artists. In light of this, we know that Vivendi Universal will celebrate our decision to institute and enforce Universal Records' artist, Ali's violations of our trademark, Boughetto/Bourghetto."
